This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. When registering on the Platform or any other Partner's platform (such as Microsoft teams or Google Chrome extension), you may be asked to enter your name, email address, Google or Office 365 credentials or other details to enhance your user experience.
We collect information transmitted by Third – Party applications in any case where you interact with Berrycast through such Third - Party applications. Note that these applications could be governed by other policies regarding personal information which may also be applicable.

We collect information from you when you access our Platform, register on our Platform, subscribe to a newsletter, enter information on the Platform or any other Partner's platform such as Microsoft Teams or Google Chrome extension.
The processing of the information is being performed automatically, without human intervention. However, whenever you contact us through email, or you request Services which require human interaction, your personal information will be handled and processed by a real human in order to provide you the requested services or the answer to the email.
We will use your name based on your consent in order to personalize your experience on the Platform and to address you properly when we contact you.

We will collect your Google or Microsoft ID in order to execute our contractual obligation and create and connect your accounts.
We integrate security systems on our Platform to prevent malicious attempts and exploits of the Platform. We scan IP address and ban IP addresses that show malicious signs such as too many password failures, seeking exploits and similar. We process this information in the interest of protecting the integrity of the Platform and of the databases connected with it, including database of Information obtained from Users. We use your IP address on a basis of a legitimate interest to maintain the integrity and safety of our databases.
Session information usually does not collect your personal Information. However, if you access the Platform through your User account, we will connect a Session ID to a User account making the session information personally identifiable. This Information is necessary for the performance of the Platform, performance of some Services, and to allow Users to log-in into their accounts.
We will collect your payment information in order to process your order for paid Services. We need this information in order to administer contractual obligations and we will not use this information for any other purposes. All payments on the Platform are conducted through third party service provider Stripe Inc. You hereby understand that by making purchase through our Platform your personal information is being processed and handled in accordance with Stripe’s privacy policy available here: https://stripe.com/us/privacy.
We collect information regarding the usage of the Berrycast application in order to offer our user the best customer experience. Through continuous improvement, we obtain such informations make strategic decisions about our product offering.
When the App crashes or fails to perform due to a software error, we will automatically collect an error report which contains technical information about the error, as well as the information about the operating system and the version of the App in which the error occurred to better help us analyze the problem and fix the bugs in the App. Error reports do not contain any personally identifiable information nor are the error reports connected to any particular user.
Unless specifically stated in this Privacy Policy, we will not sell or lease your personal information without your prior consent. Personal information may only be accessed by our personnel as required to use such information in compliance with this Privacy Policy. Personal information may also be accessed by our agents, suppliers or sub-contractors in the case where such information is required to perform their duties. These persons or organisations will undertake to keep personal information confidential and to use same only to the extent necessary to accomplish their mandate toward us.

In the event where the sale or restructuration of Berrycast is contemplated (a “Transaction”), we reserve the right to disclose personal information to persons and organisations involved both before and after the Transaction, whether or not it is actually carried out. Such persons or organisations shall commit to keep personal information confidential and to use same only to the extent required to assess the opportunity of the Transaction or in compliance with this Privacy Policy.
We may also disclose personal information to third-parties if compelled by competent authorities or if expressly permitted by law.
Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. Cookies are used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

We keep collected personal information until concerned individuals request that it be deleted or until such time where it is not required by our activities. However, except as required by applicable laws and regulations, we do not commit to keep any information for a determined length of time.
Collected personal information is stored in electronic format in our servers located in different data center around the world and is protected by commercially reasonable security measures considering the sensitivity of the information. We may store or transfer collected personal information to servers located in countries deemed adequate by the European Commission, or in countries which European Commission has not deemed inadequate, provided that such countries implement appropriate and suitable safeguards regarding the security of personal information.
Our technical team can be granted provisional access to our servers, video and thumbnail storage layers. This will always be for development and debugging purposes, for the benefit of our users. Each engineer has a unique key that identifies them within our systems. If their key is compromised, we have the capability to immediately disable that key, check if their key was used by an outsider, and mechanisms to mitigate such situations and alert the affected user base.
Occasionally, at our discretion, we may include or offer third-party products or services on our Platform. These third-party sites or plugins have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites or plugins. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites or plugins.
Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. We use Google AdSense Advertising on our Site.
Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.
We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our Site.

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of 13 years old.
We abide by the laws and regulations governing unwanted electronic communications. If you no longer wish to receive electronic communications from Berrycast, you may so advise us at any time in writing at the following address: info@berrycast.com.
We will continue to have the right to contact you about you orders, requests for information or about the handling of your personal information.
You may access our personal information and correct erroneous information through the Platform interface. You may also make a written request to that effect at the following address: info@berrycast.com.
We will respond to your written request at the latest within 30 days of receipt and will give you reasonable access to your personal information within what is permitted by applicable law. Fees could apply in certain cases.
We may verify the identity of individual seeking to access personal information. Any information provided for identification purposes will not be recorded nor used for any other purpose.
Users have the right to obtain the erasure of personal Information concerning him or her without undue delay, and we have the obligation to erase personal Information without undue delay where one of the following grounds applies, as long as the processing is not necessary:

Users have the right to receive the personal Information concerning him or her, which was provided to a controller, in a structured, commonly used and machine-readable format. Users have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to point (a) of Article 6(1) of the GDPR or point (a) of Article 9(2) of the GDPR, or on a contract pursuant to point (b) of Article 6(1) of the GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR, the User shall have the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.
Users have the right to object, on grounds relating to his or her particular situation, at any time, to processing of personal Information concerning him or her, which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on these provisions.
We will no longer process the personal Information in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the User, or for the establishment, exercise or defence of legal claims.
If we process personal Information for direct marketing purposes, the User shall have the right to object at any time to processing of personal Information concerning him or her for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If the User objects to the processing for direct marketing purposes, we will no longer process the personal Information for these purposes.
In addition, Users have the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
Users may without prejudice to any other administrative or judicial remedy, lodge a complaint with supervisory authority, in particular in the EU Member State of his or her habitual residence or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes the GDPR.
We acknowledge that the safety of your personal information is one of the highest priorities and therefore only authorized processors have access to your information. Although we take all appropriate measures in respect to keeping your information secure, you understand that no data security measures in the world can offer 100% protection. If we ever find or suspect a personal data breach we will without delay, within seventy-two (72) hours after becoming aware of it, notify the appropriate supervisory authority about the breach and Users where necessary.
We may modify this Privacy Policy to reflect changes in our business and our handling of personal information. Where a modification is made, a new Privacy Policy will be posted on the Platform and should you continue to use the Platform, you will be bound by the new Privacy Policy. We will make reasonable efforts to inform users of any modifications to this Privacy Policy, but users remain responsible to check the latest version or our Privacy Policy as available on the Platform.
The handling of personal information is governed by laws and regulations which may vary from jurisdiction to jurisdiction. This Privacy Policy as well as any associated operation is governed by the laws of the Province of Quebec and the laws of Canada applicable therein and shall be interpreted accordingly.
Any claim, dispute or complaint with respect to the subject matter of this Policy shall be brought before the competent authority sitting in the judicial district of Montreal, hereby excluding any other forum.
